I. Data collection and storage of personal data Responsible for data processing in our company / data protection officer

The owner Mirella Carpineti, Hergenstadter Strasse 8, 74740 Adelsheim, is responsible for data processing in our company.
Due to the size of our company, it is not necessary to appoint a data protection officer.

II. Data collection and storage of personal data

In order to carry out the brokerage contract concluded with you and so that we can inform you appropriately in the current contractual relationship, we need certain data from you. In this respect, we collect the following information: • title, first name, last name, • a valid e-mail address, • address, • telephone number (landline and/or mobile phone) • information that is necessary for the implementation of the contractual relationship with you. We collect this data in order to be able to identify you as our client or contractual partner and to be able to adequately fulfill our contractual obligations. Furthermore, we need this data for correspondence with you and for invoicing. If we are obliged under the provisions of the Money Laundering Act (GwG) to collect certain information, this includes the following information in accordance with Section 11 (4) GwG:

1. for a natural person: • first name and surname, • place of birth, • date of birth, • nationality and • a residential address or, if there is no permanent place of residence with legal residence in the European Union and verification of identity within the framework of the conclusion of a basic account contract in Within the meaning of § 38 of the Payment Accounts Act, the postal address at which the contractual partner and the person acting towards the obligated person can be reached;

2. in the case of a legal entity or a partnership: • company, name or designation, • legal form, • registration number (if available), • address of the registered office or main office and • the names of the members of the representative body or the names of the legal representatives and , if a member of the representative body or the legal representative is a legal entity, the data from this legal entity according to the first four points. We expressly point out that we process personal data that we collect on the basis of the Money Laundering Act exclusively for the prevention of money laundering and terrorist financing.

III. Nature, purpose and use of the data

We process the data at your request. The processing of the data is necessary in accordance with Art. 6 Para. 1 Sentence 1b) GDPR for the purposes mentioned for the appropriate processing of the brokerage contract and for the mutual fulfillment of obligations from the brokerage contract. The personal data collected by us will be stored until the end of the statutory retention period for brokers. According to Section 14 (1) MaBV and Section 8 (4) GwG, this is 5 years after the end of the calendar year in which the contractual relationship was terminated. After that, the data will be deleted, unless we are obliged to store it for a longer period of time in accordance with Art. 6 Para have consented to further storage in accordance with Art. 6 Para. 1 Sentence 1a) GDPR.

IV. Disclosure of data to third parties

Your personal data will only be passed on or transmitted to third parties within the framework of the provisions of the GDPR and the GwG. Your personal or person-related data will only be passed on if • you have given us your express consent in accordance with Art. 6 Para. 1 Sentence 1a) GDPR, • this in accordance with Art. 6 Para. 1 Sentence 1b) GDPR for processing or to fulfill our obligations under the brokerage contract, • we are legally obliged to do so according to the provisions of Art. 6 sentence 1c) GDPR or the provisions of the GwG, • disclosure is necessary to assert, exercise or defend legal claims (Art 6 (1) sentence 1f) GDPR). The prerequisite is that there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

V. Your Rights

1. Right to Object

You have the right, for reasons that arise from your particular situation, at any time against the processing of personal data concerning you, which we process on the basis of Art. 6 Para. 1 Sentence 1f) GDPR on the basis of legitimate interests, in accordance with Art. 21 GDPR objection. 2. Right of Withdrawal

You have the right, according to Art. 7 Para. 3 GDPR, to revoke the consent you have given us at any time. We may then no longer continue processing the data based on this consent for the future.

3. Right to information

You have the right, in accordance with Art. 15 GDPR, to request information from us about your personal data processed by us. You also have the right to request information about the purposes of processing. You can request information about how your personal data is categorized and to which categories of recipients your data is or has been disclosed. You also have the right to access the following information:

The planned duration for which the personal data will be stored or, if this is not possible, the criteria used to determine that duration;
the existence of a right to correction or deletion of the personal data concerning you or to restriction of processing by the person responsible or a right to object to this processing;
the existence of a right of appeal to a supervisory authority;
if the personal data are not collected from the data subject, all available information about the origin of the data;

4. Right to Rectification and Completion

According to the provision of Art. 16 GDPR, you have the right to demand the immediate correction of incorrect personal data from us. Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data - also by means of a supplementary statement.

5. Right to Erasure

According to the provision of Art. 17 GDPR, you have the right to demand that personal data concerning you be deleted immediately. This does not apply if the processing is necessary

to exercise the right to freedom of expression and information;
to fulfill a legal obligation that requires processing under Union law or the law applicable in Germany or to perform a task that is in the public interest or in the exercise of official authority that has been assigned to us or
to assert, exercise or defend legal claims.

6. Restriction of data processing

According to the provision of Art. 18 GDPR, you have the right to demand that we restrict processing if

you dispute the accuracy of your personal data;
the processing is unlawful and you refuse to have your personal data erased and instead request that the use of your personal data be restricted;
we no longer need your personal data for the purposes of processing, but you personally need them to assert, exercise or defend legal claims or
you have objected to the processing pursuant to Article 21(1).

7. Right to data portability

According to Section 20 GDPR, you have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format. You also have the right to request the transmission of this data to another person responsible without hindrance from us.

8. Right to Complain

According to the provision of Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority at your usual place of residence or at your place of work or at our company headquarters.
